ARTICLE II. - POLICE DEPARTMENT*

DIVISION 1. - GENERALLY
Sec. 50-31. Established. There is established an executive department of the municipal government
of the city which shall be known as the police department, and shall
embrace the chief and such other members as the council may by resolution
determine to be necessary. Sec. 50-32. Residency of officers. (a) Police officers are allowed to reside outside the corporate limits of the city, both at the time of appointment and while serving as such police officers, subject to subsection (b) of this section. Preference shall be given to residents if all other qualifications are equal. (b) Any person appointed to the police department under subsection
(a) of this section must become a resident of the city or a resident
of any unincorporated area within 1 1/2 miles of the city limits within
15 months after the date of his appointment. Sec. 50-33. Officers and patrol officers. The council shall determine the number of officers and patrol officers
to be on the police force. Sec. 50-34. Special police officers. The mayor may, on application being made to him, appoint any suitable
person in the employ of any corporation, association or firm, a special
police officer in and for the city; or he may, if he deems it proper,
appoint any person employed in any other branch of the city service
to be such special police officer. The mayor shall report all such appointments
to the council at its next regular meeting, and the council may continue
or discontinue the same, in its discretion. Special police officers
shall be citizens of the city and shall have all the qualifications
required in the case of regular police officers. They shall take and
subscribe the same oath give like bond, exercise the same powers, and
be subject to the rules and regulations of the police department so
far as the same are applicable to them. Such special police officers
shall receive no pay from the city for their services. Secs. 50-35--50-50. Reserved.

Sec. 50-51. Office created. There is created the office of chief of police, who shall also be the
city marshal. The chief of police shall be appointed by the mayor by
and with the advice and consent of the council. Sec. 50-52. Term. The term of office of the chief of police shall be the same as the
term of the mayor appointing him and until his successor is appointed
and qualified, or until he is removed from his office by the mayor,
whichever occurs first. Sec. 50-53. Command of police force. The chief of police shall be the commanding officer of the police force
of the city, subject to the mayor, the rules and regulations prescribed
by the council and the rules and regulations prescribed by the fire
and police commission. Sec. 50-54. Duties. The chief of police shall devote his entire time to the discharge of
the duties of his office, and shall be charged with the preservation
of the peace, order, safety and cleanliness of the city, and with the
duty of protecting the rights of persons and property, and of enforcing
all ordinances and orders of the council. The chief shall not absent
himself from the city without notifying the mayor of his intended absence,
where the same is practicable. Sec. 50-55. Abatement of nuisances. The chief of police shall take notice of all nuisances, obstructions
and defects in the streets and alleys or other public places of the
city, and shall cause the same to be abated or removed, or immediate
notice thereof given to the proper officer whose duty it may be to take
action in relation thereto. Sec. 50-56. Police record. The chief shall keep, or cause to be kept, books of record of the police
department, and of all persons arrested or committed by the police,
showing the time and place of each arrest, the offense for which the
same was made, the court before whom such person was tried, and the
disposition of each case. Sec. 50-57. Monthly reports. The chief shall, on the first Tuesday in each month, make a written
report to the council showing the number of arrests made by the police
force during the preceding month, the name of each person arrested,
the police officer making the arrest, the offense charged, the court
before whom tried, the disposition of the case, the amount of fine imposed,
if any, and the amount of such fine collected. Sec. 50-58. Care of property. The chief shall have the care, custody and control of all books, records,
equipment, and other property belonging to the police department, and
of all stolen goods seized and retained by police authority. Upon the
termination of his office he shall surrender to his successor in office,
all books, records, equipment and property in his possession belonging
to the city or pertaining to his office.
