There is created a body politic and corporate
to be known as the emergency telephone system board of the city.
The board is constituted as a public instrumentality of the city
and the exercise by the board of the powers conferred by this article
shall be deemed and held to be the performance of an essential public
function.
(a) The mayor, with the approval of the city
council, shall appoint the members of the emergency telephone system
board, whose terms of office shall commence from the date of appointment.
(b) The board shall consist of five members.
(c) On creation of the board, initial appointments to the board
shall be as follows: two members for two-year terms, two members
for three-year terms, and one member for a four-year term. Thereafter,
whenever a vacancy occurs by reason of the expiration of the term
of any member, the mayor, with the approval of the city council,
shall appoint a member to the board for a term of three years.
(d) Members of the board shall hold office until their successors
are appointed and may serve more than one successive term.
(e) Whenever a vacancy on the board shall occur as a result of resignation,
death, or any other reason other than expiration of the term of
a member, the mayor, with the approval of the city council, shall
appoint a member to complete the term of vacancy.
(f) Members of the board shall receive no compensation for their
services but shall be reimbursed for their actual and necessary
expenses.
(g) Removal from the board by the mayor shall be for cause and only
with the concurrence of the city council.
(h) The board shall determine bylaws consistent with the purposes
of this article subject to approval of the city council.
The emergency telephone system board may exercise
the following powers under this section; provided, however, that
in no event shall the board encumber city funds or incur city debt
or liability except as provided herein:
(1) Planning a 911 system.
(2) Coordinating and supervising the implementation, upgrading
or maintenance of the system, including the establishment of equipment
specifications and coding systems.
(3) Receiving monies from the surcharge imposed under section
30-1, and from any other source, for deposit into the emergency
telephone system fund.
(4) Authorizing all disbursements from the fund.
(5) Hiring, on a temporary basis, any staff necessary for the
implementation or upgrade of the system.
